DIY Conveyancing NZ - The Lodgement


In my previous post I covered the Settlement.

Sign the Transfer Instrument


So now that you have the executed Transfer Instrument you have to sign it in the box at the bottom provided for the Transferee.

For our fictitious example it then would look like this:

The Lodgement

For the lodgement you will need all of the following:

  1. Private Individual Photo ID Form that you got from the LINZ website
  2. Two copies of the LINZ Manual Dealing Lodgement Form
  3. A cheque for the Lodgement Fee (at this date that's $176)
  4. The executed and countersigned Transfer Instrument
  5. The Statutory Declaration
You can either post/courier to the addresses provided in the post The LINZ Manual Dealing Lodgement Form or you can take it in person to an LINZ office that has a drop box provided for that purpose.

That's pretty much everything.

You will receive in the mail one of your copies of the Lodgement Form with the receipt for your Lodgement Fee stapled to it.

Some time later (a week or two) you will receive in the mail a Registration Confirmation Statement. They will also return to you the Transfer Instrument, Statutory Declaration and the other Lodgement Form with various stamps and signatures added to it.

If one of the steps covered in this blog were done in error or there was some other problem you will get a different letter - which could indicate simply that you forgot to enter some information or sign something or it could be worse. I've not had a negative experience so sorry, if that happens you better try and sort it out yourself or seek legal assistance.

Remember - most people use a solicitor - a LINZ staff member stated that manual lodgements were less than 1% of all lodgements. So though there are obviously quite a few people prepared to do it themselves, they are the minority.

If we're doing the transfer instrument ourselves (transferor/daughter) and then having our lawyer (transferee/mother) file the lodgement online, do you know if the date on the transfer instrument has to be the same date or within a certain few number of days that our lawyer files the lodgement online? The only reason we need to do the lodgement via a lawyer is the bank insists on it for the new mortgage to be granted. Cheers, Warren

  2. When I did mine, the date the transfer was signed was some days before it was lodged. Understand also that it is acceptable to post a lodgement - implying that even more days can pass before it is received by LINZ (think of someone working in Scott Base wanting to sell a property - it could be weeks between signature of transfer and lodgement). The Transfer instrument is probably valid for years - under some statute of limitations (I've had a quick look and find no problem but did not search everything).

    Secondly, A member of my family and i bought a section comprising of three lots on one title uner her name. We have obtained councils cert under sec 226 and I intend to transfer the middle of the three lots to my name. I cant seem to see anything on the LINZ site that tells us how to retain the 'spare' 3rd title in her name... do you happen to know if it will by default issued in the name of the current owner of all 3 lots, or if we have to lodge an instrument to acheive this?

  4. I've been told (by a solicitor) that a solicitor can only do the transfer into the new owners name because of an ID issue. Is she right?

    1. No, she is 100% wrong (not unusual for solicitors) - but you don't need my word for it - just read the law links, the LINZ links. The ONLY time you need a solicitor is when you you are buying and you will take out a mortgage - the bank will insist on a solicitor though i wouldn't be surprised if even that could be dealt with by someone with the right stuff. Read the whole blog. Read all the links. It's about saving money not saving time. If you want to save time then use a solicitor but hunt around - the whole process for them takes minutes so it should not cost an arm and a leg.

  5. Totes agree with the conspiracy theory. Only need to see the cover sheet of the one-size-fits-all contract for buyers and sellers. Very large and prominent Copyright claim for "NZLS/ REINZ " So watch out for the section which forces the buyer and the seller to appoint a lawyer! I write, in the Further Terms of sale, "NOTWITHSTANDING anything to the contrary contained in this agreement the Seller reserves the right to do their own legal work." It means doing a manual transaction with the help of LINZ as discussed elsewhere in this blog
